NOV Fee - Discharge Violation

A NOV is a written notification stating that MCES considers an industrial user to be in noncompliance with a specific section of the MCES Waste Discharge Rules.

A discharge violation is a violation of Waste Discharge Rules Article IV (Waste Discharge Rules - PDF).

The cost recovery fee for discharge violation is $150.

NOV Fee - Administrative Violation

A NOV is a written notification stating that MCES considers an industrial user to be in noncompliance with a specific section of the MCES Waste Discharge Rules.

An administrative violation is a violation not detailed in Waste Discharge Rules Article IV (Waste Discharge Rules - PDF).

The cost recovery fee for adminstrative violation is $100.

Order to Appear (OTA) Fee

An OTA is a formal order to a specific representative of an industrial user to appear before MCES personnel for purposes of showing cause why MCES should not proceed to modify, suspend, or revoke the industrial user's Industrial Discharge Permit.

The cost recovery fee for an Order to Appear is $300.

Strength Charge

2008 Strength Charge Formula
Strength Charge = [Vx(TSS - 250)x(8.34)x(TSS Rate) + Vx(COD - 500)x(8.34)x(COD Rate)]
Strength Charge = Strength Charge, in dollars
V = Volume, in million gallons per reporting period
TSS = Total Suspended Solids, in mg/L (TSS > 250) (if TSS is less than 250 mg/L then, use 250 mg/L)
COD = Chemical Oxygen Demand, in mg/L (COD >500) (if COD is less than 500 mg/L then, use 500 mg/L)
250 = TSS threshold value, in mg/L
500 = COD threshold value, in mg/L
8.34 = Conversion Factor, converts mg/L and gallons to pounds
TSS Rate = Via on-site connection: $0.148/pound of excess TSS

= Via permitted waste hauler: $0.295/pound of excess TSS

COD Rate

= Via on-site connection: $0.074/pound of excess COD

= Via permitted waste hauler: $0.1475/pound of excess COD

Add-on Service Charge

Permittees discharging contaminated groundwater via an on-site sanitary sewer connection will be assessed an Add-on Service Charge in lieu of SAC.

In calculating the above Strength Charge, use the following: TSS rate is $0.295 per pound of excess TSS COD rate $0.193 per pound of excess COD

Each load is subject to a Service Fee of $10.00 per 1,000 gallons, which is normally billed to the waste generator.

Hauled Industrial Waste Loads must be approved by the MCES Industrial Waste & Pollution Prevention Section prior to discharge. All Industrial Waste Loads must be transported to the 3rd & Commercial disposal site located in St. Paul.

* "Region" means the area over which the Metropolitan Council has jurisdiction, including Anoka County, Carver County, Dakota County excluding Northfield, Hennepin County excluding Hanover, Ramsey County, Scott County excluding New Prague, and Washington County.
