Project #8046, Trout Brook Interceptor  

Description:

The Metropolitan Council Environmental Services (MCES) owns and operates this interceptor which  provides storm water service to numerous communities served by the Capitol Region Watershed  District (CRWD). This project provides funding for repairs to the interceptor. Upon completion of   the project, the interceptor will be in good operating condition, and will be conveyed to the CRWD.

Purpose and Justification:

The MCES has statutory authority limited to ownership, operation and maintenance of sewers defined as interceptors (MN Statute 473.121 Subd. 23) that comply with current Metropolitan Council policy plans. This interceptor no longer satisfies the criteria. If it remains in the regional system, all users of the Metropolitan Disposal System (MDS) will continue to pay for its maintenance, operation, insurance and repair.

The reconveyance program was established in accordance with the guidelines and rules laid out in MN State Statute 473.5111. The MCES will transfer, dispose of, or charge the beneficiaries of all non-regional facilities that provide primarily local trunk sewer or storm water services. The MCES carries out its duties as follows: 1). MCES will seek relief from responsibility of ownership, operation and maintenance of all stormwater facilities; 2). All non-regional facilities shall be reconveyed at no cost to the receiving local government unit; 3). Facilities will be put on a "Pending Reconveyance" list for a maximum of two years before reconveyance; 4). MCES will transfer facilities in good operating condition; 5). MCES may provide a limited 10-year warranty for sanitary and storm water sewer pipes; and 6). A 3-phase process of negotiation, mediation and administrative hearings will be used to resolve disputes.

Impact on O&M Costs:

The operation and maintenance costs associated with this facility will be eliminated once it is reconveyed back to the Capitol Region Watershed District.
